Selling in Arizona
What do you need to disclose when you sell your Arizona property??
Here is a sample of the Arizona Seller Property Disclosure form required for all Arizona Real Estate transactions. When you fill out your “Sellers Property Disclosure Form” be sure to list anything that you as a Buyer would want to know about. Sellers are obligated by law to disclose all known material (important) facts about the property to the Buyer.
This full disclosure helps protect you from future claims by the Buyer about any problems that may arise with the home.
- In most cases the buyer will order a Home Inspection Report from a licensed home inspector. This report defines the condition of the home, and then it is up to the Buyer to decide if the home's condition is acceptable or if renegotiation is in order.
- Upon review of the Home Inspection Report, the Buyer will have their agent prepare a “Buyers Inspection Notice and Sellers Response”.
This document may request, that you, as the Seller make certain repairs as a condition of moving forward with the contract.
You have 3 options as follows:
- Agree to make the requested repairs and proceed with the transaction.
- Refuse to make any of the requested repairs.
- Agree to make some (but not all) of the requested repairs.
Your response will be forwarded to the Buyer.
If you elect option #2 or #3 the Buyer may either cancel the contract or agree to proceed, accepting your position on the repairs.
This entire process sounds complicated but is actually quite simple and is timelined so it does not drag on too long. We would be happy to explain the process in detail or answer any questions you might have.
